State Senate Election Committee Chair Wendy Rogers Demands Election Logs from 2022 Election in Pinal County

Concerned about allegations of wrongdoing and voter disenfranchisement in Pinal County’s 2022 election, State Senator Wendy Rogers (R-Flagstaff), chair of the Senate Election Committee, sent the county a public records request demanding printout logs from the election. She asked for the EL52S, EL30A, and EL45A reports/logs. 

“Given the importance of free, fair, and transparent elections and the public’s skepticism regarding the conduct of recent elections, I am seeking production of these documents on an expedited basis.” She gave the county a deadline of 10 days to produce the documents, warning, “Any deletion of said public documents can give rise to a negative inference in a court of law.”

Maricopa County Superior Court Judge Brad Astrowsky conducted a hearing Wednesday regarding Maricopa County and Runbeck Election Systems’ motions to dismiss a lawsuit filed by We the People AZ Alliance (WPAA). WPAA requested video surveillance from Runbeck showing ballots being transferred to and from Runbeck on Election Day and the day after the 2022 general election. Runbeck refused to turn them over, claiming it was not subject to public records requests as a private entity, so WPAA sued the company.

We the People AZ Alliance Sues Maricopa County for Failing to Provide Ballot Envelopes for Public Records Request

We the People AZ Alliance (WPAA) filed a lawsuit against Maricopa County on April 25 for refusing to fulfill their public records request for ballot envelopes containing signatures from the 2022 election. The Verified Complaint for Statutory Special Action to Secure Access to Public Records From Defendants stated that the public records request was submitted on April 5 and denied by the county on April 10. 

WPAA tweeted about the rejection on Wednesday, “A.R.S. 16-168(F) is not a catch to hide information from the public. Signatures are filed on deeds, court documents and licenses and made public. Ballot affidavit envelopes are not by design part of a voter record, we are committed to bringing the truth to light.”

The Goldwater Institute Sues the City of Phoenix for Not Producing Requested Union Records

The Arizona-based Goldwater Institute (GI) announced Wednesday that it had filed a lawsuit against the city of Phoenix for refusing a public records request relating to union records.

“The public’s business should be done in public, not behind closed doors,” says GI Staff Attorney Parker Jackson, lead attorney on the case. “The city of Phoenix has a duty to comply with state law—and the city’s own code—so that residents can find out what their government is up to.”

Abe Hamadeh’s Team Allegedly Delayed in Inspecting Maricopa County Adjudication Logs, Warns More Legal Action May Come

Republican Abe Hamadeh shared Thursday that Maricopa County had allegedly delayed his team’s efforts to inspect the County’s adjudication log from the 2022 election following a public records request.

“Maricopa County told my team that they were available for inspections this week. After we arrived yesterday morning the County kicked us out after just one hour. Maricopa County continues to obstruct and conceal – my team is prepared for litigation,” tweeted Hamadeh.

Arizona Court of Appeals to Hear Case Involving 2020 Maricopa County Ballot Images

Audit USA (AU), a nonpartisan organization based in Arizona focusing on election integrity, will have an opportunity to present arguments in the Arizona Court of Appeals Wednesday in a case involving Maricopa County and ballot images.

“I’m hopeful we will win this case because the facts are with us and transparency in our elections is vital for democracy,” said John Brakey, co-founder and director of AU. “Transparency is the currency of trust and without it, our democracy will die in darkness.”

Cyber Ninjas Must Turn over Records from the Maricopa County Ballot Audit, State Appeals Court Says

The Arizona Court of Appeals rejected a request from Cyber Ninjas, the company that audited Maricopa County’s ballots, to block a public records request by the media for records from the audit. Phoenix Newspapers Inc., which owns The Arizona Republic, asked for emails and other documents in its April request, which the lower trial court granted. Cyber Ninjas appealed the decision. The appellate court rejected the cyberfirm’s argument that opening its records up for public inspection would allow opening the records of any contractor that does business with the state. 

Jack Wilenchik, Cyber Ninja’s attorney, expressed his disappointment to Capitol Media Services, “The government cannot force private contractors to produce things the government does not own. He said it’s similar to a violation of the Fourth Amendment protections against search and seizure.
