Arizona Becomes First State to Sue Biden Administration over Its New COVID-19 Mandate

Arizona became the first state in the nation to sue the Biden administration over its federal vaccine mandate, according to Attorney General Mark Brnovich’s press release.

“The federal government cannot force people to get the COVID-19 vaccine. The Biden Administration is once again flouting our laws and precedents to push their radical agenda,” Brnovich said. “There can be no serious or scientific discussion about containing the spread of COVID-19 that doesn’t begin at our southern border.”

Last week, President Joe Biden announced that by executive order would coerce all employers with over 100 employees to force their workers to get the coronavirus vaccine. The president said during his speech that this would affect 80 million Americans.

“Many of us are frustrated with the 80 million Americans who are not vaccinated,” Biden said.

In Arizona’s lawsuit, it argues this executive order violates the Fourteenth Amendment’s Equal Protection Clause by requiring Americans to get the vaccine, but not illegal immigrants who come into America. The Biden administration currently allows illegal immigrants to decline the vaccine, according to the press release.

Furthermore, Brnovich in his brief called the vaccine mandate “one of the greatest infringements upon individual liberties, principles of federalism, and separation of powers ever attempted by an American President.”

“Under our Constitution, the President is not a king who can exercise this sort of unbridled power unilaterally, the brief said. “And even George III wouldn’t have dreamed that he could enact such sweeping policies by royal decree alone.”

The Biden administration may face even more potential lawsuits from Republicans. After Biden announced his executive order, Republican National Committee Chairwoman Ronna McDaniel said the committee would sue the administration. Republican governors from South Dakota, Florida and Georgia have also threatened legal action.

This is not the first time Arizona has taken legal action against the Biden administration. Last month, Brnovich filed an amicus brief with 15 other states in an attempt “to halt the Biden administration’s ‘Interim Guidance’ policy of not enforcing laws against illegal immigration when it comes to crime.”
